VAT exemption applies to qualifying school tuition fees
Spain's VAT law exempts qualifying educational services, including school tuition supplied by public bodies or authorized private education providers, from value-added tax. This exemption entered into force on January 1, 1993, and remains in effect. It applies to the core teaching service regardless of a family's nationality or residency status, rather than being limited to particular citizens. Some ancillary services, such as sports programs run by a separate business or catering supplied by an external company, may fall outside the exemption, though meals provided directly by the school to its own pupils remain exempt. No national proposal to introduce VAT on private or international school tuition was identified.

Foreign schools enrolling Spanish nationals must add Spanish language and culture
Under Royal Decree 806/1993, authorized foreign schools in Spain that enrol Spanish nationals at compulsory-education ages must supplement their foreign curriculum with Spanish language and culture, including geography and history relevant to the autonomous community, and the co-official regional language where applicable. This requirement attaches to the school's authorization category rather than to the pupil's nationality alone, and applies to schools admitting both Spanish and foreign pupils. Post-compulsory programs are not subject to the same staffing requirement unless the provider also operates compulsory-level provision under this route. This rule has been in force since June 24, 1993.

Foreign-curriculum-only schools cannot enrol Spanish nationals at compulsory ages
Under Spain's national framework for foreign schools, institutions that teach exclusively a foreign curriculum at compulsory-education levels may not enrol children holding only Spanish nationality, unless the child also holds the nationality of the country whose education system the school follows. This is a nationality-based eligibility condition rather than a percentage quota. Schools that additionally meet the requirement to teach Spanish language and culture may enrol Spanish nationals under a separate authorization category. At non-compulsory levels, foreign schools may enrol both Spanish and foreign pupils without this restriction. This rule has been in force since 1993.
